Agreement

These terms apply to this website and to the services of Apex Media Growth. When you hire us, you also sign a Marketing Services Agreement; if the two differ, the signed agreement controls.

Services

Our Growth Plan includes Facebook and Instagram ad management with up to 4 new ad creatives a month, 12 organic posts a month (8 designed posts and 4 short videos edited from footage you supply), Google Business Profile management with 4 posts a month, a lead follow-up system (forms, CRM, automatic text and email replies, missed-call text-back and review requests), and a monthly report with a 30-minute call. Anything else is quoted separately.

Fees and billing

The Growth Plan costs $997 per month. There is no setup fee. Fees are charged automatically by card or ACH through our payment processor, Stripe, on the same day each month. Advertising spend is not included: you pay Meta and other ad platforms directly with your own payment method. We recommend a minimum ad spend of $450 per month.

Term and cancellation

The first term is 3 months. After that, service continues month to month and either side can cancel with 30 days' written notice to apexmediama@gmail.com. We may pause or end service if a payment is not resolved within 7 days or if these terms are broken.

AI receptionist plans

Ava Starter ($197 per month, 150 call minutes a month included) and the Ava AI Receptionist ($397 per month) have no setup fee and no minimum term: they run month to month and you can cancel at any time by writing to apexmediama@gmail.com before your next billing date. Monthly fees are not refunded for partial months. Ava Starter has a 30-day guarantee: if within 30 days of your first payment you tell us Ava isn't a fit, we refund your first monthly fee in full ($197). It applies only to the first month and once per business. The 3-month first term above applies only to the Growth Plan.

Refunds

See our Refund Policy. In short: there is no setup fee; monthly fees are not refunded for partial months; Ava Starter has a 30-day guarantee on the first month; and if we miss the monthly posts or new ads, your next month is half price.

No guarantee of results

Marketing results depend on many things outside our control, including your offer, prices, competition and how fast you answer leads. We do not guarantee any number of leads, appointments, sales or revenue.

Your responsibilities

  • Give us partner or manager access to your ad accounts, pages and Google Business Profile. We never ask for passwords.
  • Provide accurate information, lawful offers and any licenses your business needs.
  • Review content within 48 hours; after that it is considered approved.
  • Respond to the leads the system delivers.

Ownership

You own your ad accounts, pages, profiles and all content delivered and paid for. We keep our templates, processes and know-how. We only show your results publicly with your written permission.

Text messaging terms

Apex Media Growth sends text messages to people who request information or book calls with us: replies, appointment confirmations, reminders and follow-up about their request. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. Use of this website

Don't misuse the site, try to break its security or copy its content for commercial use without permission.

Limitation of liability

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 3 months before the claim, and we are not liable for indirect or consequential losses, such as lost profits.

Governing law

These terms are governed by the laws of the State of Texas.
